Being in a car accident is stressful — and Florida's insurance rules add another layer of complexity. Here's a clear, step-by-step guide to what you should do after a collision in Florida, from the scene to getting your vehicle repaired.
1. Make Sure Everyone Is Safe
Before anything else: check on yourself and passengers. If anyone is injured, call 911 immediately. If the vehicles are in a dangerous position and can be moved safely, move them out of traffic. Turn on your hazard lights.
2. Call the Police
In Florida, you are required to report any accident that results in injury, death, or apparent property damage of at least $500. Even for minor fender benders, filing an official report creates a record that can protect you later in the insurance claims process.
Wait for the officer to arrive, provide an honest account of what happened, and ask for the report number before you leave. You'll need this for your insurance claim.
3. Document Everything at the Scene
Use your phone to take photos of:
- All vehicles involved, from multiple angles
- Damage to each vehicle (close-up and wide shots)
- License plates
- The surrounding area, including road conditions, signs, and signals
- Any visible injuries
Also exchange information with the other driver: name, phone number, driver's license number, insurance company and policy number, and vehicle make/model/year.
4. Don't Admit Fault
Stick to the facts when talking with other drivers, police, or witnesses. Don't apologize or admit fault at the scene — even if you think you may have been responsible. Fault determination is a legal process that considers many factors, and statements made in the moment can be used against you later.
5. Understand Florida's No-Fault Insurance
Florida is a no-fault state, which means your own Personal Injury Protection (PIP) coverage pays for your medical expenses and lost wages up to your policy limit — regardless of who caused the accident. Every Florida driver is required to carry at least $10,000 in PIP coverage.
For vehicle damage, however, you either use your own collision coverage (if you have it) or pursue the at-fault driver's property damage liability coverage.
6. Report the Accident to Your Insurance
Call your insurance company as soon as possible — ideally within 24 hours. Provide the basic facts, the police report number, and the other driver's information. Your insurer will assign a claim number and walk you through next steps.
7. Get a Medical Evaluation Within 14 Days
Florida law requires you to seek medical attention within 14 days of the accident to qualify for PIP benefits. Even if you feel fine, some injuries (whiplash, concussions, soft tissue damage) don't show symptoms immediately. Getting checked protects both your health and your insurance claim.
8. Choose Your Own Body Shop
This is important: you have the legal right to choose any licensed body shop in Florida for your repair. Your insurance company may recommend a "preferred" or "network" shop, but you are never required to use them. Choose a shop based on quality, reviews, and warranty — not just insurance convenience.

9. Get an Independent Estimate
If you have any doubt about the insurance adjuster's estimate, get one from an independent body shop. A reputable shop will provide a free, detailed estimate and can often identify hidden damage the adjuster missed. If the estimates differ significantly, the shop can work directly with your insurer to document the additional repairs needed.
10. Keep Records of Everything
Save every document related to the accident: police report, medical records, repair estimates, receipts, and all correspondence with insurance companies. These records are essential if the claim becomes disputed or if you need to file a supplemental claim later.
